By a resolution vote at this past Monday’s meeting, City Administrator Bryce Davis was approved as the new EMS Director. Also acted on, in a separate agenda item, was approval of an increase in compensation for Matt Valentine as a reserve officer for the City. He will go to a $14 per hour rate effective immediately, with any other reserve officers the City might employ in the future starting at $12 per hour. The rates for Valentine shall be considered retroactive and the compensation difference shall be paid, according to all deductions and payroll personnel procedures, to him and each future employee from May 1 of this year.
A resolution was approved for a settlement agreement in the matter of Shanice Lloyd’s dog incident from this past May. Her dog, a Pyrenees named “Dwight” bit a child riding past Lloyd’s home on her bike. The dog was then declared a dangerous animal, with Lloyd appealing the decision to the Council under the City’s code of ordinances. Both parties then desired to agree to certain regulations and restrictions, which would protect the public interest without branding the dog as dangerous as defined by code.
The stipulations of the agreement include: 1) Lloyd must keep the dog confined indoors, or in a secure fenced-in yard sufficient to confine the dog in the yard. If away from the residence, the dog must be securely leashed and restrained by Lloyd or another person competent to control and restrain the dog; 2) Lloyd must not sell, give away or otherwise dispose of the dog without written authorization of the City; 3) At her expense, Lloyd must microchip the dog to allow for indentification; 4) The City does not deem, and Lloyd does not admit, that the dog is a dangerous animal as defined by City Code; 5) This agreement is in force and effect for as long as the dog is alive and within City limits. It also states that, in the event of a breach of this agreemrnt, Lloyd will pay the City $750 as liquidated damages for each breach. The sum is fixed as an attempted reasonable estimate of probable loss, and not as a penalty.
In other action the Council:
-heard from Davis the opening of the aquatic center for this summer is still under review;
-set a public hearing for the July 6 meeting for reviewing and voting on the proposed plans, specs, form of contract and estimated cost for the downtown revitalization project;
-approved a resolution to dispose of the property at 211 North Iowa. The property will be renovated and the Council will now seek bids for the work;
-discussed an addition to City Code requiring backyard private pools to be fenced in. It was referred to Planning & Zoning to have a recommendation come back to the Council at a future meeting;
-approved building permits for Mike Boyd (shed), Ben Franklin (garden center), Brandon Hauck (fence), Jakama Holding (sidewalk), Patricia Martinez (deck), Bradley DeVries (deck) and Logan Poncin (fence);
-approved cigarette permits for Ampride, Casey’s General Store, Dollar General, Fareway and Kum & Go;
-approved a beer/liquor/wine license for Eagle Grove Greenhouse.
