All three individuals charged with stealing grave markers have a tentative trial date set while the suspects are all pleading not guilty.
Bond for Brandon Scott Smith, 43, of Hampton, has been amended to $20,000 cash or by surety with a pretrial conference set for March 20 at 1:15 p.m. and a jury trial April 8 at 9 a.m.
The amended bond, changed from cash only, came after a review by Judge Blake Norman.
The judge noted factors influencing the decision.
โDefendant has a criminal history including but not limited to criminal mischief and in the Worth County case resulted in a burglary conviction in 2022, Norman wrote. โDefendant was given probation and violated his probation for failing to keep in contact with his probation officer. He incurred driving convictions while on probation and failed to make any payments toward financial obligations. The defendant stated he is readily able to be employed and listed numerous employers. However, he admitted to not being employed at the time of arrest and his financial affidavit shows no income for a 12-month period. He does have some ties to the community due to his fiancรฉ living in Hampton.โ
Norman also noted the defacing of public monuments as well as the involvement of veterans and veterans tombstones with the gravity.
Smith remains incarcerated at the Hardin County Jail on behalf of the Franklin County Sheriffโs Office.
Court records show Lauren Johnson, 33, of Dumont, has posted cash bond of $10,000 already.
Rachel Card, 31, of Hampton, has also posted bond.
Both currently have the same trial date as Smith.
Theft – first degree and criminal mischief – first degree, both Class C felonies, have been filed for all three defendants.
A Class C felony carries up to 10 years in prison for each count, making the three eligible for up to 20 years each if convicted.
