(Photo by Cami Koons\/Iowa Capital Dispatch)<\/figcaption><\/figure>\r\n<p><em>By\u00a0Cami Koons<\/em><\/p>\r\n<p>The Iowa House Judiciary Committee advanced bills Thursday to block hazardous liquid pipelines carrying carbon dioxide from the use of eminent domain.\u00a0<\/p>\r\n<p>Two bills also advanced granting rights to intervene in Iowa Utilities Commission proceedings, which GOP lawmakers have done against the case of the Summit Carbon Solutions pipeline project.\u00a0<\/p>\r\n<p><a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=91&amp;ba=HSB287\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">House Study Bill 287<\/a> specifies that the \u201cconstruction of hazardous liquid pipelines for the transportation or transmission of liquefied carbon dioxide\u201d does not constitute a public use for the purpose of condemning agricultural land.\u00a0<\/p>\r\n<p>The bill would apply to any condemnation proceedings made on or after its enactment.\u00a0<\/p>\r\n<p>Committee members voted to advance HSB 287. A companion bill in the Senate, <a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ba=SF%2092&amp;ga=91\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Senate File 92<\/a>, has not had any scheduled hearings and will likely be \u201cdead\u201d at the end of the funnel week.\u00a0<\/p>\r\n<p><a href=\"https:\/\/iowacapitaldispatch.com\/2025\/03\/06\/south-dakota-governor-signs-eminent-domain-ban-on-carbon-pipelines\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">South Dakota Gov. Larry Rhoden signed a similar bill into law Thursday morning<\/a>, that effectively bans the use of eminent domain for carbon dioxide pipelines. South Dakota is also on the proposed route for the Summit Carbon Solutions pipeline project, which would transport sequestered carbon dioxide from biofuel refineries to underground storage in North Dakota.\u00a0<\/p>\r\n<p>Rhoden said the new law is not meant to \u201ckill\u201d the project in South Dakota, but should be taken as \u201can opportunity for a needed reset.\u201d\u00a0<\/p>\r\n<p>Summit Carbon Solutions said in a statement the news is \u201cvery unfortunate\u201d but \u201cthe project moves forward in states that support investment and innovation.\u201d<\/p>\r\n<p><a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=91&amp;ba=HF491\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">House File 491<\/a> would also restrict hazardous liquid pipelines from the right of eminent domain, by adjusting the definition of a common carrier.\u00a0<\/p>\r\n<p>Under the bill, a hazardous liquid pipeline would have to establish \u201cclear and convincing evidence\u201d that it transports a commodity used by an individual consumer, or a commodity for one or more shippers not affiliated with the carrier who will also not sell the hazardous liquid to the carrier.\u00a0<\/p>\r\n<p>Rep. Charley Thomson, said the bill \u201ccorrects a problem that emerged because of the Summit pipeline docket hearings in front of the Iowa Utilities Commission.\u201d\u00a0<\/p>\r\n<p>Summit\u2019s status as a common carrier has been a subject in several lawsuits, including one in which the <a href=\"https:\/\/iowacapitaldispatch.com\/2024\/11\/22\/iowa-supreme-court-upholds-land-survey-abilities-of-pipeline-companies-in-summit-case\/#:~:text=The%20case%20involved%20Kent%20Kasischke,underground%20storage%20in%20North%20Dakota.\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Iowa Supreme Court reiterated that the company meets the requirements <\/a>of a pipeline under Iowa Code.\u00a0<\/p>\r\n<p>The bill advanced 20-1, and Thomson said there will be an amendment on the floor to clarify that the bill does not apply to railroads.\u00a0<\/p>\r\n<h4 class=\"editorialSubhed\">Intervenor bills<\/h4>\r\n<p>Thomson and House Judiciary Committee Chair Rep. Steven Holt are part of a <a href=\"https:\/\/iowacapitaldispatch.com\/2024\/09\/10\/iowa-republicans-to-file-lawsuits-against-summit-pipeline-decision\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">large group of GOP lawmakers who have intervened<\/a> against the Summit Carbon Solutions pipeline project. Holt and Thompson also pushed forward <a href=\"https:\/\/iowacapitaldispatch.com\/2024\/03\/28\/iowa-house-passes-eminent-domain-bill-for-pipelines\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">legislation last year to restrict eminent domain<\/a>, but the bills did not gain necessary momentum in the Senate.\u00a0<\/p>\r\n<p><a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=91&amp;ba=HF610\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">House File 610<\/a> would allow members of the General Assembly, county and city elected officials and Iowans with \u201cminimally plausible interest\u201d to intervene in an Iowa Utilities Commission proceeding.\u00a0<\/p>\r\n<p><a href=\"https:\/\/www.legis.iowa.gov\/legislation\/BillBook?ga=91&amp;ba=HF237\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">House File 237<\/a> would prohibit the IUC from \u201cthreatening or imposing sanctions\u201d on an intervenor unless they were intentionally dishonest or violated a criminal statute that caused injury to the commission in excess of $500.\u00a0<\/p>\r\n<p>Both bills advanced from committee with votes of 20-1.<\/p>\r\n<p><em>\u00a9Copyright 2025, Iowa Capital Dispatch.
